Defending Reptile Tactics in Discovery and at Trial

Reptile theory is a litigation strategy steadily gaining traction across all types of litigation, from products liability to premises liability to employment litigation. This strategy uses trial tactics that appeal to the jurors’ “reptile” brain, triggering an emotional self-interested reaction in jurors, in order to tap into ever-increasing jury verdicts. During this breakfast seminar, Erin Grewe of Campbell Conroy & O’Neil will discuss this issue and how combatting reptile theory begins well before the parties enter the courtroom for trial through discovery, depositions, and motion practice.
